D9 Vendor Disclosure

By processing this order, the Purchaser (whether retail or wholesale) acknowledges that the Company’s product(s) contain Delta-9 tetrahydrocannabinol (Delta-9 THC) that has been derived from industrial hemp and has a Delta-9 THC concentration of 0.3% or less by dry weight. Delta-9 THC is a cannabinoid molecule that has intoxicating effects. 

By processing this order, the Purchaser warrants it will, to the best of its ability: 

  1. limit physical access to the Company’s products within the Purchaser’s place of business;
  1. require all retail customers to produce a valid government-issued identification such as a US driver’s license evidencing the customer’s date of birth; and 
  2. decline to sell the Company’s product to any prospective retail customer for whom the Purchaser is unable to confirm that the customer is at least 21 years of age as evidenced by the customer’s government-issued identification.  

A Retail Purchaser further agrees that it shall display, in a clearly visible location, an adhesive window sticker supplied by the Company which states that the Retail Purchaser sells the Company’s products, that such sales are limited to customers aged 21 and over, and that the Retail Purchaser verifies prospective customers’ ages in connection with sales of the Company’s products.

The Purchaser further agrees that it shall not distribute, sell or otherwise cause to be in the stream of commerce any of the Company’s products in a state or municipality where such products are prohibited. Wholesale Purchasers shall not distribute or sell to any retail customer in a location where products like those produced by the Company are prohibited. If a Wholesale Purchaser discovers that any of its retail customers are selling in a prohibited jurisdiction, it shall terminate distribution to that retail customer, alert the Company and make best efforts to work with the Company to retrieve any of the Company’s unsold products from said retail customer(s).  

The Purchaser further agrees that in the event the Company determines that it must withdraw any of its products from the market for any reason, the Company shall issue a written notice requesting a withdrawal of the product.  Upon receipt of such notice from the Company, the Purchaser will cooperate with the Company and make arrangements for the impacted product to be quarantined pending further instructions from the Company. For wholesale Purchasers, this requirement must be communicated to their retail customers—as the withdrawal will apply equally to all ultimate customers of the Company’s product.
